Scope
These General Terms and Conditions govern the purchase of artworks and other products offered through the PamArt website.
By placing an order, the customer acknowledges having read and accepted these Terms and Conditions.
Prices
All prices displayed on the website are expressed in Euros (€) and include VAT where applicable.
PamArt reserves the right to change prices at any time. Any changes will not affect orders that have already been confirmed.
Payment Methods
Purchases may be made using the payment methods available at checkout.
Currently accepted payment methods include:

Credit and debit cards;

PayPal;
-
Pay in 3 with PayPal, where available and subject to PayPal approval.
All transactions are processed through secure payment platforms. PamArt does not store or have access to customers’ payment card information.
Any installment payment option is governed exclusively by PayPal’s Terms and Conditions.
Shipping Costs and Delivery Times
Shipping is available throughout Italy.
Delivery generally takes between 2 and 5 business days, excluding weekends and public holidays.
For certain destinations, such as Italian islands or remote locations, delivery times may vary.
Quadrocchi
Shipping costs are:

€5.00 within mainland Italy;
-
€8.00 to the Italian islands.
Ready-to-Ship Artworks
Shipping costs vary depending on the size, weight, and type of artwork purchased.
The exact shipping cost will be calculated automatically and displayed in the shopping cart before the order is confirmed.
Right of Withdrawal
Pursuant to Articles 52 and following of the Italian Consumer Code (Legislative Decree No. 206/2005), consumers have the right to withdraw from the purchase of ready-to-ship artworks and ready-to-ship Quadrocchi within 14 days of receiving the product, without providing any reason.
To exercise the right of withdrawal, the customer must send a written notice within the legal time limit using the contact details provided on the website.
Returned products must be:
-
unused and undamaged;
-
complete, where possible, with their original packaging;
-
properly protected for return shipping.
Return shipping costs are the responsibility of the customer unless otherwise required by law.
Once the returned product has been received and inspected, PamArt will issue the appropriate refund in accordance with applicable legislation.
Exclusion of the Right of Withdrawal
Under Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to custom-made or clearly personalized artworks.
This includes, for example:

commissioned artworks;
-
customized dimensions;
-
customized colors;
-
customized compositions.
Before confirming the order, customers may request photographs, videos, or additional information regarding commissioned artworks.
Products Damaged During Shipping
Upon delivery, customers are advised to inspect the packaging carefully.
If the product has been damaged during transport, the customer must notify PamArt within 48 hours of delivery by sending photographs and a video showing:

the outer packaging;
-
the inner packaging;
-
the damage to the artwork.
After verifying the claim, PamArt will, depending on the circumstances, provide:

a replacement artwork;
-
a refund; or
-
a store credit.
Store Credit
If a store credit is issued, it will remain valid for 12 months from the date of issue.
It may be used to purchase:
-
ready-to-ship artworks;
-
Quadrocchi;
-
commissioned artworks.
Legal Warranty
All products sold by PamArt are covered by the statutory legal warranty of conformity provided under Articles 128 and following of the Italian Consumer Code, where applicable.
The warranty covers only defects existing at the time of delivery and does not apply to damage resulting from improper use, impacts, accidental drops, normal wear and tear, or improper storage of the artwork.
Limitation of Liability
The photographs displayed on the website are intended to represent the artworks as accurately as possible.
Since each artwork is handmade and photographed under different lighting conditions, slight variations in color perception may occur between the images shown online and the artwork in person. Such variations shall not be considered defects or grounds for claims.
Governing Law and Jurisdiction
These General Terms and Conditions shall be governed by the laws of Italy.
Any dispute relating to purchases made by consumers shall be subject to the jurisdiction of the court of the consumer’s place of residence or domicile, in accordance with applicable law.
For purchases made by non-consumers, the Court of Pavia (Italy) shall have exclusive jurisdiction.
Original Artworks
All artworks sold by PamArt are entirely handmade and are original creations.
Minor imperfections, textures, reliefs, and characteristics resulting from the handcrafted production process are distinctive features of each artwork and shall not be regarded as defects or lack of conformity.
